Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing or struck-by hazards when operating a forklift without using the seatbelt: In the shop: On or about June 16, 2009, and at times prior thereto, employees operating the Hyster H35XL forklift did not use the seatbelt nor were they required to do so. Note: Abatement certification required for this item. Note: Among other methods one feasible and acceptable means of abatement to correct this hazard would be to establish a work rule that seatbelts be worn when operating the powered industrial truck and ensure the work rule is enforced by conducting periodic inspections of the operators.s
