Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown off and struck-by a forklift truck: (a)On Sept. 4, 2008, and at times prior thereto, an employee was exposed to a struck by hazard when operating the JLG - Sky Trac rough terrain forklift without using the provided and functional seatbelt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the requirements of ANSI B56.6-2002 Standards for Rough Terrain Forklift Trucks and the manufacturers operating instructions which states that the operator shall fasten the seat belt around them. Note #1: Abatement certification IS NOT required for this item.
