Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and
a place of employment which were free from recognized hazards that were
causing or likely to cause death or
serious physical harm to employees in that employees were exposed to a
material lift tipping over and/or losing its
load while driving with the load elevated to a level which exceeded the
manufacturer maximum elevation:
a)East end of cold storage area, bay adjacent to the south exterior wall;
On or about 2/18/09 and at times
prior thereto, the operator of a JLG, Model 10054 rough terrain material
lift traveled distances up to 50
feet with the load elevated  from 20 to 47 feet above the ground level.
The operator was placing
multiple 3,200 - 3,300 pound 5 foot high by 8 foot wide by 83 foot long
prefabricated steel roof
joist/wood deck assemblies up to the roof deck level.
Note 1: Among other methods, one feasible and acceptable abatement method
to correct this hazard is to
follow JLG's Operating Guide for the material lift being utilized which
limits the load elevation during travel to
a maximum of 11 feet.
Note 2: Abatement certification and documentation IS required for this
item.
