Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pinned under, crushed, or thrown from a forklift truck. a)Loading Dock: On or about February 25, 2009 and at times prior thereto, a Hyster H50H fork lift used for trans-loading trailers, was used without a seat belt. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the forklift is equipped with the appropriate restraint device, system, or enclosure as required by section 7.41 of ITSDF B56.1-2005 and train or retrain all fork lift operators on the hazards and requirements to use seat belts at all times. Note: Abatement certification is required for this item.
