Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling objects: a.Site - The worker was less than one tree length away from the tree being felled. b.Site - Loose limbs (widowmakers) were not removed from trees so as not to create a hazard for others in the work area. ABATEMENT NOTE: Among other methods, one feasible and acceptable mens of abatement would be to remain at least one tree length from the tree being felled, as described by American National Standards Institute (ANSI) Z133.1 - 2006 for Arboricultural Operations - Safety Requirements.
