Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential hazard of oxygen deficiency while entering the inside of the water tower tank, a Permit Required Confined Space (PRCS), without proper monitoring of atmospheric conditions prior to and during entry: a.Job site - On or about 8/25/09, the confined space entry supervisor permitted workers to enter and work inside the water tower tank, a PRCS, after testing the atmosphere inside the water tower tank and determining that the oxygen level was 18.6 These conditions could result in asphyxiation. Among other methods, feasible and acceptable abatement methods to correct this hazard would be to follow the procedures set forth in ANSI Z117.1-1989 "Safety Requirements for Confined Spaces," and/or implementing Bullins Painting Inc.'s (BPI) own written Confined Space Entry Program. Implementation of an acceptable program must include elements such as, but not limited to: 1.Perform air sampling throughout the inside of the water tower tank to determine acceptable air quality conditions; 2.Permitting worker entry into the water tower tank only after acceptable air quality conditions have been determined; 3.Follow the equipment manufacturer's instructions for pre- and post-calibration of air sampling instruments used to test the air quality inside water tower tanks; 4.Utilize forced air ventilation to eliminate any hazardous atmosphere inside the water tower tank before work is permitted; and, 5.Provide for permit space rescue and emergency services.
