North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to fall hazards while working in a personnel basket:
a)receiving, the personnel basket used with the forklift to
lift personnel was not provided with standard railings
and the plywood bottom showed signs of rot.
Reference:  The American National Standards Institute
(ANSI) Safety Standard For Powered Industrial Trucks,
ANSI B56.1-1975, Section 427, on elevated platforms.
Among other methods, one feasible and acceptable method
to abate this hazard is to install standard railing which
includes a top rail between 36" to 42" in height, a mid-
rail installed half way between the top rail and floor of
platform, and a toe board installed around the floor of
the platform which measures at least 4" in height.
