Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard while accessing the stairs with no mid rails. a.Stairs leading to the operator's cabin, located on the left side of the dock did not have intermediate(mid) rail. b.Stairs leading to the cat walk on the ginning machine, were not equipped with intermediate(mid) rail. WHILE ULTIMATE RESPONSIBILITY FOR CORRECTING THE HAZARDS RESTS WITH THE EMPLOYER, GIVEN HIS/HER SUPERIOR KNOWLEDGE OF THE WORK PLACE, FEASIBLE AND ACCEPTABLE METHODS OF ABATEMENT TO CORRECT THIS HAZARD, AMONG OTHERS ARE: 1. A feasible means of abatement would be to follow the requirement for guards 7.1, in the American National Standard, Safety requirement for floor and wall openings, and toeboards; ANSI A12.1-1973.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to electrocution or shock hazard while using an Arc welder with a damaged cord. At the time of the inspection an employee was observed welding support bars on a mobil cart. a.An Arc welder with a damaged welding cord was not repaired or replaced prior to use by employees. WHILE THE ULTIMATE RESPONSIBILITY FOR CORRECTING THE HAZARDS RESTS WITH THE EMPLOYER, GIVEN HIS/HER SUPERIOR KNOWLEDGE OF THE WORK PLACE, FEASIBLE AND ACCEPTABLE METHODS OF ABATEMENT TO CORRECT THIS HAZARD, AMONG OTHERS IS: 1. A feasible means of abatement would be to follow the requirement of the ANSI Z49.1-1999, paragraph 11.5.4.ph
