Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the pendant control for the crane used to move fork truck batteries had unlabeled control buttons exposing employees to serious struck-by injuries if the crane operator moved the batteries in an unintentional direction. (a)Janesville Acoustics, Div. of Jason, Inc., 405 Industrial Parkway, Norwalk, OH: On or about January 14, 2008, the employer did not ensure that that the pendant control buttons were properly labeled for the crane used to change fork truck batteries. Among other methods, one feasible and acceptable method to correct this hazard is to ensure the pendant control buttons are properly labeled as to their function according to ASME B30.11-1998 "Monorail and Underhung Cranes." In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
