Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees.
(a)Rademacher Industrial System, Inc., site address: 7800 St. Rt. 109,
Delta,
OH:  On or about June 25, 2008, employees were exposed to pinch point
hazards
while riding the bucket of the John Deere 200C excavator to the bottom of
the
excavation.  The bucket was a specially designed, clam-shell bucket that
was
hydraulically powered and operated by the controls in the cab of the
excavator.
One method of abatement would be to follow the safe operating procedures
set forth in the
Association of Equipment Manufacturers (AEM) safety manual for Hydraulic
Excavators
(HE-60-1), which states on page 20 -"Never use a bucket for a work
platform
or personnel
carrier."
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this
violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
