Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees, in that, employees were exposed to struck-by/crushing hazards due to an inadvertent release of the crane load: a. Slob and Sons Pipe & Casing, Inc., 207 North State Steet, Marion, Ohio: On or about March 24, 2009, employees were using a Yale five ton underhung hoist in which the wire rope had numerous broken strands, up to 40 strands per foot, per lay, the sheave block was damaged from wear and side loading of the hoist, the hook was missing its keeper, and the pendant control was not marked to indicate the direction of hook travel. The condition of one or more crane components could expose employees to being struck-by four foot diameter pipe casings that weigh up to two tons while operating in near proximity of the load. Among other methods, one feasible and acceptable abatement method to correct these hazards is to follow the American Society of Mechanical Engineers, ASME B30.16 - 2007 Safety Standards for Overhead Hoists (Underhung), Chapter 16-2 Inspection, Testing and Maintenance as applicable. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.t,
