General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees, in that, employees were exposed to a struck-by hazard due to the potential for a dropped load: a. Marion Electric Motor Service, Inc., 400 Barnhart Street, Marion, Ohio: On or about March 26, 2009, the employer did not ensure that a Budgit 2 ton hoist was equipped with a hook safety latch when lifting pieces up to approximately 1000 pounds. Among other methods, one feasible and acceptable method to correct this hazard is to: Replace missing hook latches as per ASME B30.16-2007 16-1.2.9 states "Hooks shall be equipped with latches". In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
