Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to struck/crush-by hazards:
a)  Quality Painting and Roofing Systems worksite located at 11027 Convoy
Rd. in Van Wert,
Ohio:  On or about July 9, 2009, the employer permitted employees to
perform roofing
operations from a platform that was suspended by a Genie Telehandler rough
terrain forklift
truck.  The forklift truck is designed for material handling only, and is
not to be used to lift
personnel.  Employees working from the suspended platform were exposed to
fall hazards of up
to approximately 30 feet.
b)  Quality Painting and Roofing Systems worksite located at 11027 Convoy
Rd. in Van Wert,
Ohio:  On or about July 9, 2009, employees were exposed to struck/crush-by
hazard
while
permitted to work under the elevated portion of a Genie Telehandler rough
terrain forklift truck.
The forklift truck was being used with a platform to elevate personnel who
performed roofing
operations.  An additional employee was permitted to work from a ladder
that was under the
elevated load to assist in roofing operations.
Abatement Note:  Among other methods, one feasbile and acceptable means of
abatement to
correct this hazard is to comply with American National Standard Institute
(ANSI) B56.6-2005:
Safety Standard for Rough Terrain Forklift Trucks.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
