Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees performing work functions, such as but not
limited to,
operating an aerial lift were exposed to the hazard of being struck by
vehicular traffic:
(a) Wilkes and Company, Inc. on or about July 13, 2009, at the address of
205 Sprowl Rd.
Huron, OH: The employer failed to ensure employees were protected from
motor vehicle
traffic while working-in/crossing active lanes of traffic. An employee
operating a Genie
Model S-85 Aerial Lift entered a two lane county road to rotate the lift's
boom arm around
to face the working area without controlling the traffic or utilizing
other protective means
and was struck by an oncoming vehicle.
Abatement Note: One feasible and acceptable method to correct this hazard
is to instruct
employees not to enter active lanes of traffic while operating mobile
equipment. When the
job task requires an employee to enter the roadway, the employer shall
train and require
employees to use temporary traffic barriers, high visibility flags or
flashing lights outlined in
ANSI 92.5 Section 8.10.2, in that the employer should to eliminate
employee's exposure to
struck-by hazards posed by vehicular traffic.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this
violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET),
and in addition, documentation demonstrating that abatement is complete
must be
included with your certification.  This documentation may include, but is
not limited to,
evidence of the purchase or repair of the equipment, photographic or video
evidence of
abatement, or other written records.
