North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees in that employees were exposed to the hazard of being crush by a falling vehicle: a)Lube Express, Bays 5 & 6 - where the employer did not implement or maintain periodic inspections for a Forward Manufacturing (MN DP09A) "Two Post Asymmetrical" automotive lift used to service automobiles. Employee(s) were using "swing arms" without a 1/2 x 3/4 NC Bolt positioned to prevent the "swing arm" from sliding out of the "Long Slide. ABATEMENT NOTE: Among other methods, one feasible method to reduce this hazard is to follow the owners manual which states that the equipment should be inspected monthly. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to electrical hazards in that, the electrical receptacle was not equipped with a Ground Fault Circuit Interrupter: a)Lube Express, Oil Change Pit - where employee(s) were exposed to duplex receptacles that was not equipped with Ground Fault Circuit Interrupter. Employee(s) used a duplex receptacle to power a work light while changing oil in the oil change pit. ABATEMENT NOTE: Among other methods, one feasible method to reduce this hazard is to follow the National Electrical Code (NEC) section 511-Commercial Garages which states all receptacles shall be equipped with GFCI. [Reference: Article 511.12 Ground-Fault Circuit-Interrupter Protection for Personnel. National Electrical Code (NEC) 2005 Edition]
