North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to: crushing hazards.
a)facility - where on 01/08/08 an employee received serious injury as a
result of the employer's
failure to ensure that the company driver of truck # 74 (Oklahoma license
#2LG 298) cleared
before and while backing the vehicle.
Note*  Among other methods, feasible and acceptable methods to correct
this hazard are to: (1) Apply the
brakes on the highway trucks or trailers, apply wheel chocks or other
positive mechanical means to prevent
intentional or unintentional movement of highway trucks and trailers
during loading/unloading operations.  (2)
Conduct analyses/audits of loading dock areas and operations to include:
policies and procedures for dock
plate/ramp positioning, load configurations, dock equipment systems, dock
design/layout,
types of vehicles
using dock, interaction of employees with material handling systems, and
(3) Train employees in dock safety
procedures and practices. (4) Provide training and evaluation for company
drivers to ensure they do not fail to
clear before backing.
