North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall while in the basket that was lifted, approximately 10' by the Case forklift and no one at the controls of the forklift: a)Job Site - employees being lifted to a height of approximately 10' with a case forklift and the operator not remaining in the seat to operate the controls of the forklift to prevent inadvertent operation of the lifts controls. Among other methods, one feasible and acceptable abatement method would be to properly train all forklift operators that they remain in the operators seat when lifting personnel in or on a work platform.
