North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards by the collapse of an overloaded scissor lift: a)on the construction site, the MEC Scissor Lift, Model 2033, was overloaded with 5 persons. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method would be to follow the manufacturers requirement of (3) persons max.
