North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls in excess of 18-feet [Reference ASME B56.1-1993, Section 7.35]: a)new commercial construction site - where employees were elevated to work positions using a locally manufactured metal work platform which was not secured to the GEHL 663, 35-foot Extendible Boom, Rough Terrain Forklift. Among other methods, one feasible and acceptable abatement method to correct this hazard is to secure the platform with appropriate chains or other securing devices before lifting personnel. Reference: ASME B56.1-1993, Paragraph 7.35.3, "Work platforms (does not include operator platforms) shall comply with para. 7.35.1 and, in addition, shall have:(c) means to securely attach the platform to the lifting carriage or forks, and to prevent the lifting carriage or forks from pivoting upward;" b)new commercial construction site - where the employer provided a locally manufactured metal work platform which was used with the GEHL 663, 35-foot Extendible Boom, Rough Terrain Forklift. The operational capacity of the platform had not been identified by the employer. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use an appropriately designed personnel lifting equipment such as scissors-lift type vehicles or bucket trucks. Reference: ASME B56.1-1993, Paragraph 7.35.3 "Work platforms (does not include operator platforms) shall comply with para. 7.35.1 and, in addition, shall have: (h) the combined weight of the platform, load, and personnel not to exceed one-half of the capacity as indicated on the nameplate of the truck on which the platform is used; (i) the following information prominently indicated on the platform: (1) maximum load including personnel and equipment; (2) weight of empty platform; (3) minimum capacity of truck on which the platform can be used."
