North Carolina General Statute 95-129(1) of the Occupational Safety and
Health
Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to being struck by falling loads due to the
disregard of the industry recognized
standard in that items used to support the pulley are not load rated:
a)site-employees of a subcontractor were exposed to falling loads in that
the cross pieces of
scaffold, wire used to connect pulley to cross pieces, length of cross
pieces over the edge of
the end of the scaffold, an approximate seven foot span, and the 1/4" bent
piece of rebar used
as a hook, are not rated to lift a bucket of stucco, estimated at up to
100 pounds, are not rated
for the task.
One feasible means of abatement is to install and use a properly rated
hoisting system.g
