Nevada Revised Statute 618.375(1):  The employer failed to furnish
employment and a place
of employment which was free from recognized hazards that were causing or
were likely to
cause death or serious physical harm to his employees:
The employer failed to use safety devices and safeguards as follows:
a.At the Arroyo jobsite, located at 6550 South Buffalo, two LM Construction
employees were working from a JLG Gradall Personnel Platform, model #
9045 5052, serial #2003161147,  performing framing duties. for
approximately
one hour. One of the employees stood on the top and middle guardrail to
gain
additional height, and was tied off to the mast of a JLG Material Handler;
Model # 524/534D6/9/10/544, serial #JLGOP0210489, instead of using the
engineered anchor points on the platform. The employees were exposed to
possible serious injuries from falls approximately 25 feet to the ground
below.

Section 5.17.1 Operator Training: The user shall ensure that operators
understand
that safe
operation is the operator's responsibility. The user shall ensure that
operators are
knowledgeable of, and observe, the safety rules and practices.
Section 8.10.1 Personnel Footing:  Personnel shall maintain a firm footing
on the platform
floor while working therein. Use of planks, ladders, or any other devices
on the aerial
platform for achieving additional height or reach shall be prohibited.

Section 6.0 Operation:  The platform shall not be moved until the park
brake is applied and
the occupants are wearing a full body harness with a lanyard attached to
designated point.
One feasible means of abatement is to make sure that the proper personnel
fall protection
equipment required to do the job is provided and utilized correctly and
personnel maintain
firm footing at all times while using the Personnel Platform.
