Nevada Revised Statute 618.375(1): The employer failed to furnish
employment and a place of
employment which were free from recognized hazards that were causing or
were likely to cause
death or serious physical harm to his employees:
The employer failed to furnish employment free from recognized hazards as
follows:
(a)At the City of Henderson City Hall building on Water Street, three
employees
access cooling towers on the "P" level roof to perform maintenance and
repair
work.  To access the unit, employees used a 6-foot Werner A-frame ladder
leaned
against the unit, or placed next to it and climbed on and off the ladder
from the
side.  The bottom of the access opening was 6 feet 8 inches high, which was
substantially higher than the highest usable step of the ladder,
approximately 3
feet 10 inches high, for a difference of 2 feet 10 inches.  The employees
were
exposed to possible serious injuries from falls in the instance that the
ladder
displaced.

Climbing Ladders (p.15): Never climb onto a ladder from the side.
Improper Use (p.15): Ladders shall not be used for other uses for which
they
were not intended.
ANSI A14.5 - 2000 American National Standard for Ladders - Portable
Reinforced Plastic - Safety Requirements
Section 9.3.7 Climbing Ladders: The user shall not climb onto a ladder
from the
side... unless the ladder is secured against sideways motion or has been
tied to
the structure.
One feasible means of abatement would be to follow the manufacturer's
and/or
ANSI requirements.s
