Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to furnish employment that was free from recognized hazards as follows: a.At The Croix jobsite, an employee operated a Kenworth Concrete Mixer and attempted to back up into a tight spot without ensuring the path to the rear of his vehicle was clear of obstacles. The vehicle struck a utility pole with live electrical wires. The utility pole and live electrical wires toppled over onto a scaffolding unit that was set up around Building 18. The fabricated metal scaffolding frame became temporarily energized from the contact of live electrical wires that caused the immediate area to be evacuated, cordoned off, and forced roofer(s) on an adjacent building to stop work and leave the area until electrical power was shut off. The employer failed to implement procedures to ensure that drivers look for obstacles and get reliable help in backing into or out of tight spots. Reference: NRMCA Publication Number 188, Truck Mixer Driver's Manual, 1999, Page 26 & 27, section 4 - Avoiding On-The Job Problem, paragraph 2 - Entering The jobsite instructs the driver to ""Look for obstacles and get reliable help in backing into or out of tight spots."" One reasonable means of abatement would be to ensure that employees are trained on back up procedures by incorporating back up procedures into employers drivers training program.
