Nevada Revised Statute 618.375(1): The employer failed to furnish employment and
a place of employment which was free from recognized hazards that were causing
or were likely to cause death or serious physical harm to his employees: The emp
loyer failed to ensure automotive lifts in the shop were properly maintained and
operated, as follows: a.That operators of automotive lifts were instructed in t
he safe use and operation of lifts using the manufacturer-provided instructions
and warning labels and the Automotive Lift Institute publications. ANSI/ALI ALOI
M-2000, Para 4.2.1. The employer did not have operator manuals for lifts 1-3. Li
fts 1 and 2 did not have warning labels. Lift 1 capacity plate was partially cov
ered with spray paint.
Lift 2 did not have a capacity plate. b.That operator training on automotive lif
ts was documented using the operator training log. ANSI/ALI ALOIM-2000, Para 4.3
. The employer did not have any operator training documentation. c.That malfunct
ioning lifts were locked and tagged out until repairs were made by qualified aut
omotive lift service personnel. ANSI/ALI ALOIM-2000, Para 4.5. Lift 3 had pliers
attached to the air strut to secure the lift ramp. Lift 3 also had black tape a
round the air tubes. d.That periodic inspection procedures were established in a
ccordance with the recommendations of the lift manufacturer in order to ensure r
eliability and allow the continued safe operation of the lift. ANSI/ALI ALOIM-20
00, Para 5.1. e.That a preventive maintenance procedure was established in accor
dance with
the recommendations of the lift manufacturer in order to ensure reliability and
allow the continued safe operation of the lift. ANSI/ALI ALOIM-2000, Para 6.1.1
