General-duty citation text

Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer did not provide a place of employment which was free from
recognized hazards,
as follows:
a.Toro Greens Master.  Employees were using a greens mower that did not
stop when
pressure was released from the accelerator pedal.  Employees used the
greens
mower
weekly.  It was last used on May 07, 2008 prior to being removed to the
maintenance
shop for repairs.  Employees were exposed to serious injuries.  The brakes
were adjusted
for proper operation prior to the close of the inspection.
Per owner's manual:
On p. 4:  Apply service brakes when going downhill to keep forward speed
low
and to maintain control of the machine.
On p. 5:  Be sure entire machine is in good operating condition.
On p. 14: Brake pedal actuates an automatic drum-type mechanical brake
located
at each traction wheel.
b.Toro Reelmaster.  Employees were using a fairway mower that surged after
pressure on
the accelerator pedal was released.  Employees used the mower weekly.  It
was last used
on May 19, 2008 prior to being fixed.  Employees were exposed to serious
injuries.
It
was fixed prior to the close of the inspection.
Per owner's manual:
On p. 41:  The machine must not creep when traction pedal is released.  If
it
does creep, an adjustment is required.
c.John Deere.  Employees were using a tractor with an inoperable seat
safety switch.  The
safety switch under the tractor seat did not shut down the engine when the
seat was
vacated by the operator.  Employees used the tractor weekly and were
exposed to serious
injuries.  The tractor was last used on May 13, 2008 just prior to being
fixed later that
day.
Per owner's manual:
On p. 31:  Tractors are equipped with an operator presence system.  If the
mid
or rear power take off (PTO) is engaged without the operator on the seat,
the
tractor engine will stop.  If the PTO is engaged and you leave the seat,
the engine
will stop.
d.Jacobson Tee Mower.  Employees were using a mower that did not stop
after pressure
was released from the accelerator pedal.  Employees were exposed to
serious injuries. The employer was in the process of disputing a May 08,
2008 injury claim involving
defective brakes on the mower.  The brakes were fixed on May 09, 2008.
Per owner's manual:
On p. 14:  When driving forward, release accelerator pedal and machine will
automatically stop.  Whe driving in reverse, release accelerator pedal and
slowly
apply foot brake.
Per safety decals:
To Stop.  Remove foot from accelerator and apply brake.  Place traction
lever in
neutral. Engage parking brake.
One feasible means of abatement would be to follow the requirements of the
owner's
manual to
ensure reliability and allow the continued safe operation of the golf
course maintenance
equipment.e
