NYSLL Article 2, Section 27-a.3.a(1): The employer did not furnish employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm to employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees. In applying this paragraph, fundamental distinctions between private and public employment have been recognized. (a) Great Neck Village DPW- The employees in the Department of Public Works who have landscaping reponsibilities were exposed to the hazard of Lyme disease infection, through bites from potentially infected ticks. Feasible and useful abatement methods for reducing this hazard, among other are: (1) Training: A comprehensive training program for employees with exposure which includes the signs and symptoms of Lyme disease infection, the importance of seeking immediate medical attention, self inspection for attached ticks at the conclusion of each workday when exposure to tick habitat occured, the proper method of removal of attached ticks, proper clothing for work in tick habitat, and proper use of repellents and insecticides.
