NYSLL Article 2, Section 27-a.3.a(1): The employer did not furnish to each
of its employees,
employment and a place of employment which was free from recognized
hazards that are causing
or were likely to cause death or serious physical harm to its employees
and which will provide
reasonable and adequate protection to the lives, safety or health of its
employees. In applying
this paragraph, fundamental distinctions between private and public
employment have been
recognized. A reasonable and adequate abatement method, among others,
would be for the
employer, through a competent person, to develop and enforce a policy
requiring employees
working on aerial lifts to wear a restraining device (belt) when a
personal fall arrest system
alone may not mitigate the hazard. The restraining device would be used
specifically at the start
of the work task and when a boom is elevated or lowered. In addition, a
personal fall arrest
system may be used which provides effective clearance from contacting
lower levels  or objects
and does not interfere with vehicle bucket control devices.
a) Garden City Vill DPW:
1. The employer failed to keep the workplace free of a hazard to which
employees of that
employer were exposed: The employer required street lighting employees to
use Miller
Revolution Titan by Honeywell T5111/6FTAF 6-Feet Web Shock-Absorbing
Lanyards in their
fall arrest systems when working on aerial lifts while repairing street
lights. These systems
required a minimum clearance distance of 12'-13' when fully deployed,
exposing employees to
the hazard of striking the ground, lower level, or other mechanical
equipment when working at
elevations with less than 12'-13' of clearance.
2. The hazard was recognized: The hazard of falling from the bucket of a
truck-mounted
articulating boom lift is recognized by ANSI A92.2 standard. Also the
employer recognized the
fall hazard as they had purchased lanyards for employees.
3. The hazard was causing or likely to cause death or serious physical
harm: Falls of this nature
can cause serious physical injuries including, but not limited to: broken
bones, concussion,
internal injuries or death.
4. There was a reasonable and adequate methods to abate the hazard:
Reasonable and adequate
method to eliminate the hazard include, but are not limited to: use of a
personal restraining
device whenever there is not sufficient clearance for the full deployment
of a personal fall arrest
system.
