Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a crush by hazard from not wearing a seat belt while operating machinery: a.Fairfield Inn Marriott - An employee was operating a JLG Lull Telehandler rough terrain fork truck ( model 944E-42) without wearing a seat belt, as observed on 05/21/2008. Abatement Note: Among other methods, one feasible and acceptable abatement methods to correct this hazard included but not limited to: enforce employees usage of seat belts when operating equipment, and follow ANSI/ASME B56.6-2002, Safety Standard for Rough Terrain Forklift Trucks.
