Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees exposed to crushing injuries in the event of an accident / equipment roll over and the provided seat belt was not utilized: (a)Road & Parking Lot Area adjacent to Guard House: The provided seat belt was not worn by the operator of the 416 E Cat rubber tired back hoe as observed on 10-3-08. (b)Road & Parking Lot Area adjacent to Guard House: The operator of the Massey Ferguson 241 tractor operated the tractor with out a seat belt as determined on 10-3-08. Abatement Note: One feasible and acceptable abatement method to correct this hazard is for the employer to ensure seat belts were operable and to enforce the utilization seat belts.ation
