Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to crushing injuries associated with the roll over of a lift truck with out an operable seat belt: (a)Yard Area: The operators of the Cat rough terrain fork lift (TH 460 B) did not utilize the seat belt as determined on 1-13-10. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train employees and effectively enforce the use of seat belts when the equipment is provided by the manufacturer. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
