Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees exposed to crushing injuries in the event of an accident / equipment roll over and the provided seat belt was not utilized: (a)Pipe Laying Operation at 6th & Cherry Streets: The provided seat belt was not worn by the operator of the Komatsu WB 140 rubber tired backhoe as observed on 7-14-09. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard include but not limited to: enforce employees usage of seat belts when operating equipment.
