Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees exposed to crushing injuries in the event of an accident / equipment roll over and the provided seat belt was not utilized: (a)Tacketts Branch Road Adjacent to Bridge: The provided seat belt was not worn by the operator of the John Deere 444 H front endloader as observed on 8-06-09. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard include but not limited to: enforce employees usage of seat belts when operating equipment, and follow the John Deere the manufacturer's requirements and the Safety Manual for Wheel Tractor / Loader written by the Construction Industry Manufacturers Association.
