Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to crushing injuries associated with the roll over of a lift truck with out an operable seat belt: (a)Project at Greenbrier Valley Airport: The operator of the SkyTrak rough terrain fork lift did not utilize the seat belt due to the seat belt's latching mechanism was inoperable as determined on 10-20-09. Abatement Note: Among other feasible and acceptable abatement methods to correct this hazard are to ensure that seat belts on equipment are operable and that the operator utilizes the seat belt. The ASME B56.1-1993 Safety Standard for Low and High Lift Trucks require the usage of an operator restraint system at all times. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
