Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to crushing injuries while operating the McCormick Tractor without wearing seat belts: (a)Front of Metal Building The operator of the McCormick tractor equipped with a front bucket did not utilize the seatbelt as determined on 9-14-10. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure all earth moving equipment has an operable seat belt and to train employees and effectively enforce the use of seatbelts when the equipment is provided by the manufacturer. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
