Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to crushing injuries while operating excavator without wearing seat belts: (a)Rt. 11 Water Line Project: The operator of the Komatsu 138 excavator did not utilize the seatbelt as observed on 6-8-10. (b)Rt. 11 Water Line Project: The operator of the Komatsu 228 excavator did not utilize the seatbelt as observed on 6-8-10. (c)Rt. 11 Water Line Project: The operator of the Lay-Mor broom did not utilize the seatbelt as determined on 6-8-10 to ensure the seat belts that are provided by the manufacturer of the equipment are operable and to train employees and effectively enforce the use of seatbelts. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
