Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to crushing injuries while operating excavator without wearing seat belts: (a)Road Adjacent to Fuel Storage Tank: The operator of the Hyundai HL 740 TM 7 front end loader did not utilize the seatbelt as determined on 6-7-10. (b)Road In Front of the Office Trailer: The operator of the JCB rubber tired back hoe did not utilize the seat belt as determined on 6-7-10. Among other methods, one feasible and acceptable abatement method to correct these hazard is to ensure all earth moving equipment has an operable seat belt and to train employees and effectively enforce the use of seatbelts. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
