Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to crushing injuries while operating the rubber tired back hoe without wearing seat belts: (a)Metal Building Under Construction: The operator of the CASE 580 E rubber tired back hoe could not utilize the seat belt since it was not operable as determined on 3-10-10. Among other methods, one feasible and acceptable abatement method to correct these hazard is to ensure all earth moving equipment has an operable seat belt and to train employees and effectively enforce the use of seat belts. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
