Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees exposed to crushing injuries while operating excavators with out wearing seat belts: (a)Water Line Project Rt. 7: The operator of the John Deere 50 C excavator did not utilize the seat belt as determined on 8-24-10. (b)Water Line Project Rt. 7: The operator of the JCB excavator did not utilize the seat belt as determined on 8-24-10. Among other methods, one feasible an acceptable abatement method to correct this hazard is to ensure all equipment have operable seat belts and to train employees and effectively enforce the use of seat belts when the equipment is provided by the manufacturer as determined on 8-24-10. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
