Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to contusions, head injuries, etc., in the event of an impact and the seat belt was not in use: (a)Main Production Area: The Nissan propane fueled fork truck was provided with a seat belt but was not worn by the operator, on or about October 28, 2008. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train employees and effectively enforce the use of seat belts when the equipment is provided by the manufacturer. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
