Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: a)West Side of Building on 3rd Street - A foreman and laborers, removing sheets of mahogany trim from a tractor trailer in the street without using reflective vests, were exposed to vehicular traffic, on or about 01/17/08. Among other methods, one feasible and acceptable abatement methods to correct this hazard is to establish and enforce use of reflective vests when working in the street, barricade the area where employees were working or completely block the street to vehicular traffic.
