Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to fall and struck-by hazards through the improper use of an aerial lift: On 12/19/07, during window cleaning activities at the Washington Business Center located at 1351 Jefferson Street, Washington, Missouri, an employee(s) was being raised in a Genie Self- Propelled Elevating Work Platform, Model Number, PLC-30P. The lift tipped over dropping the operator approximately 30 feet.The lift was being operated without the outriggers that support the lift. Three other employee(s) working nearby were exposed to being struck by the lift's boom and basket. One method of abatement to correct this apparent hazard is to install the four outriggers prior to using the Genie Self-Propelled Elevating Work Platform as required by ANSI/SIA A92.6- 1999; Section 8.8(1) of Manual of Responsibilities for Dealers, Owners, Users, Operators, Lessors, Lessees, and Brokers, and the Genie Personnel Lift Operator's Manual, Part No. 29787; Operating Instructions Setup No. 1-7. DISCLAIMER: a) The employer is not limited to the abatement method(s) suggested by OSHA. b) The employer is responsible for selecting and implementing an effective abatement method. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).n
