Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not wearing a seat belt while operating a powered industrial truck: Establishment - The Clark lift truck was not provided with a seat belt, nor was it the practice to wear the seat belt while operating the Nissan lift truck. One method of abatement is to retrofit the Clark lift truck with a seat belt, and ensure all operators wear the seat belts at all times while operating the lift trucks.ng
