Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees,
in that, employees
were exposed to:
Work site, 63 Boardman Road, New Milford, CT.:  On or about 4/3/08
employee was exposed
to struck by or crushed by hazards from the improper use of equipment, the
dumpster was
suspended on the loading sill and jammed cardboard was being pulled from
the dumpster which
caused the dumpster to dislodge from the trunion bar and swing around and
hit the employee.
Amoung other methods, one feasible and acceptable abatement method to
correct the hazard is
to: follow the requirement of ANSI Z245.1 - 1999, Mobile Wastes and
Recyclable Materials
Collection, Transportation, and Compaction Equipment Safety Requirements
which states in
Section 6.2.5.7.4 Rear loader container handling - When operating rear
loader equipment with
trunion bar container lifting devices: a) Ensure that latches that secure
the container to the lifting
device are engaged and b) Ensure that when the volume of material within a
container
exceeds
the volume capacity of the loading hopper, partially empty the container
into the hopper, then
lower the container to contact the ground, so as to prevent the action of
the packer panel on the
material from interfering with the container and the latch-up mechanism,
until the compaction
cycle is completed, at which time the container may then be raised to
empty the remaining
contents. The New Way (compaction body) operation manual for the cobra and
viper models,
on page 3-18.8 states that the operator will stand clear while the
dumpster is being unloaded into
the hopper.
