Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to potential crushing injuries in the event of a fork truck tip-over. Fork truck operators were not provided with seat belts: Production areas: The Yale and Allis Chalmers forklifts were not provided with seatbelts. Among other methods, one feasible and acceptable method to correct the hazard is to: Install a seatbelt retro-fit kit and require the seatbelts be worn when the trucks are operated. Specific abatement documentation is required.
