Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to potential crushing injuries in the event of a fork truck tip over. Fork trucks were not provided on the fork trucks: Production Areas: Seat belt restraint systems were no installed on the Caterpillar # 495R and Hyster S-100 forklifts. Among other methods, one feasible and acceptable method to correct the hazard is to: Install a seat belt retro fit kit and require that a seat belt be worn when the trucks are operated. Specific abatement documentation is required.tion
