Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crushing hazards: Warehouse: 1. The seat belts on the Yale forklift serial N518681 were not in working condition. 2. The Yale forklift serial 397452 was not provided with seat belts. Among other methods, one feasible and acceptable method to correct this hazard is to: Install a seat belt retro-fit package and forklift 397452 and repair/replace the seat belts on forklift N518681 and enforce the use of the seat belts each and every time the trucks are operated.
