Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential releases of anhydrous ammonia and/or fire hazards: Company: The engine room and related equipment were not designed, installed and maintained in accordance with generally accepted good engineering practices such as those contained in The International Institute of Ammonia Refrigeration (IIAR) Standard 2, Equipment, Design, and Installation of Ammonia Mechanical Refrigerating Systems: A.Engine Room: 1.The mechanical ventilation system, ammonia detectors and alarm systems were not tested either in accordance with manufacturer's guidelines or at least annually. (IIAR 2, Section 6.2.2) 2.The room was not provided with continuous ventilation at a normal (non-emergency) ventilation rate equal to .5 cubic feet per minute per square foot. (IIAR Section 6.2.3.4) 3.An air intake or other provisions for make-up air had not been provided for the engine room. (IIAR 2, Section 6.2.3.7) 4.The engine room ceiling was constructed out of wood trusses and decking. Also, plywood was used on the wall. (IIAR 2, Section 6.3.1.1) B.Freezer: A manual, slow-closing gate valve was used to drain oil from a collection pot in the freezer instead of either a self-closing valve or a manual quick-closing emergency stop valve. (IIAR 2, Section 7.1.2) Among other methods, one feasible and acceptable abatement method is to review generally accepted consensus standards regarding ammonia refrigeration systems to ensure that the company's mechanical refrigeration system is designed, installed and maintained in accordance with recommended guidelines.
