Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crushing hazards: Production Area: An employee was observed operating a Mitsubishi forktruck, Model F820K-T without wearing the seatbelt provided. Feasible and acceptable methods to correct the hazard include: Providing seatbelt extensions for those employees who need them, to allow the seatbelt to be worn comfortably; training employees regarding the importance of wearing the seatbelts provided; and enforcing the company policy that seatbelts must be used each and every time the truck is used.
