Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to impalement hazards while walking and working at and near 1/2 inch diameter lightning rods that extended approximately 16 inches from the roof deck. One feasible and useful method to correct the hazard, among others, would be to install rebar caps on the lightning rods: 100 Pearl Street Window Repair Project: Employees were exposed to impalement hazards while walking and working at and near unguarded lightning rods.ning
