Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from struck by hazards: a) Receiving Area - The storage racks along the center aisle had damaged legs, feet and support columns due to being struck by the WAVE, on or about May 9, 2008. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the racks are inspected, repaired and maintained in accordance with Rack Manufacturers Institute (RMI) MH16.1- 1997.
